1. Introduction
These Terms of Service (the "Terms") govern access to and use of BiteWise, including the BiteWise chef application, the BiteWise client application, related websites, software, databases, content, interfaces, subscription features, and services (collectively, the "Service"). The Service is designed to help restaurants, chefs and food-service professionals manage restaurant profiles, dishes, recipes, ingredients, menus, allergens, additives and related food information, and to help end users discover and interact with such information. By creating an account, using the Service, accessing the Service as a guest, subscribing to Chef Pro, uploading content, or otherwise using BiteWise, you agree to these Terms. If you do not agree, you must not use the Service. If you use the Service on behalf of a restaurant, business or other organization, you represent that you have authority to bind that organization. In that case, "you" and "your" refer both to you personally and to the organization you represent. The Privacy Policy, Cookie Policy, Account Deletion Policy, Subscription and Refund Policy, Community Guidelines and any additional policies referenced in the Service form part of the contractual framework for using BiteWise.

3. Eligibility and Accounts
3.1 Minimum age
You must be at least 16 years old to use the Service. If the law of your country requires a higher age or parental consent for the use of online services, you may use the Service only if you meet that requirement or have valid consent from a parent or legal guardian.
3.2 Registration and sign-in
BiteWise may offer one or more authentication methods, including email and password authentication and other supported sign-in methods. At the time of this Master Version, the core registration method is email and password.
3.3 Accuracy of account information
You must provide accurate, current and complete information when creating or updating your account. You must keep your account information reasonably up to date.
3.4 One account per person
Unless BiteWise expressly permits otherwise, each individual may maintain only one personal account for the relevant role. You may not create multiple accounts to bypass restrictions, avoid moderation, obtain unauthorized benefits, manipulate ratings, or interfere with the Service.
3.5 Security of credentials
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify BiteWise promptly if you suspect unauthorized access or use of your account.
3.6 Email changes and password recovery
The Service may allow password reset or recovery through the supported authentication process. Email address changes may not be available at all times. Where email changes are not supported, the email used during registration remains the account email unless BiteWise provides another method.
3.7 Guest use
The Client App may allow limited guest use. Guest access may be restricted, changed or discontinued. Certain features, such as saving favorites, creating comments, ratings or managing account settings, may require a registered account.
4. Chef Accounts, Restaurants and Team Use
4.1 Eligible Chef Users
The Chef App is intended for restaurant owners, chefs, sous chefs, administrators, managers and other authorized food-service professionals. By using the Chef App, you confirm that you are authorized to create, manage or edit the restaurant, dish, menu, recipe, ingredient or related content that you submit.
4.2 Restaurant profile
Chef Users may create or manage restaurant profiles, including restaurant name, country, city, address, map location, photos, description, website, number of tables, average bill and similar information. You are responsible for ensuring that such information is accurate, lawful and not misleading.
4.3 Team and internal access
If a restaurant allows employees, contractors or team members to use an account or related access, the restaurant is responsible for their actions. Login credentials must not be shared in a way that compromises security or violates these Terms.
4.4 Restaurant authority
BiteWise may request additional information to verify that a User is authorized to manage a restaurant profile or related business content. BiteWise may suspend or restrict access if it reasonably believes that a restaurant profile is inaccurate, unauthorized, fraudulent, misleading or disputed.
5. Acceptable Use
You agree to use the Service only for lawful, safe and legitimate purposes, and in accordance with these Terms, applicable policies and applicable laws.
5.1 General rules
- You must not use the Service to violate any law, regulation, third-party right, contractual duty or food-safety obligation.
- You must not upload, publish or transmit content that is illegal, harmful, fraudulent, deceptive, infringing, defamatory, hateful, threatening, abusive, obscene, sexually explicit, exploitative or otherwise inappropriate.
- You must not impersonate another person, restaurant, organization or representative, or misrepresent your affiliation with any person or business.
- You must not interfere with, disrupt, overload, scan, scrape, reverse engineer, attack, bypass, compromise or attempt unauthorized access to the Service or any related system.
- You must not upload viruses, malware, scripts, automated tools or code intended to harm, disrupt, extract data from or manipulate the Service.
- You must not use bots, crawlers, mass uploads, automated scraping, credential stuffing, fake accounts, rating manipulation or other abuse mechanisms unless expressly authorized by BiteWise in writing.
- You must not use the Service to send spam, unauthorized advertising, commercial solicitations, phishing messages or fraudulent communications.
- You must not copy, extract or reuse data from the Service in a way that violates these Terms, applicable law, third-party rights or the integrity of the Service.
5.2 Public and community behavior
Where the Service allows comments, ratings, reviews, reports or other public interactions, you must communicate respectfully and honestly. BiteWise may remove or restrict content that it reasonably considers abusive, manipulative, fraudulent, discriminatory, offensive, unsafe, irrelevant or harmful to the community.
5.3 No misuse of food information
You must not intentionally submit false, unsafe or misleading Food Data, including false allergen, additive, ingredient, nutrition, calorie, menu, label or restaurant information. Chef Users remain responsible for verifying Food Data before using it in a professional food-service context.
5.4 Enforcement
BiteWise may investigate suspected violations and may hide, remove or restrict content, suspend accounts, disable features, block access, preserve evidence, report illegal conduct to appropriate authorities, or take other reasonable action to protect Users, third parties and the Service.
6. User Content
6.1 User responsibility
You are solely responsible for your User Content and for ensuring that you have all rights, permissions, licenses and consents necessary to submit, upload, store, display, process and use that content through the Service.
6.2 Types of User Content
User Content may include restaurant profiles, dishes, recipes, ingredients, menu categories, photos, labels, logos, comments, ratings, reviews, favorites, profile information, avatar images, reports, messages to support and other materials submitted through the Service.
6.3 Content license to BiteWise
You retain ownership of your User Content. However, you grant BiteWise a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, process, display, publish, transmit, adapt, modify, translate, analyze and otherwise use your User Content as necessary to operate, provide, secure, improve and promote the Service, comply with law, enforce these Terms and provide user-facing features.
6.4 Public Content
If you submit Public Content, you understand that it may be visible to other Users and may be displayed through the Service. Public Content may include restaurant profiles, dish photos, dish descriptions, comments, ratings and similar materials. You should not submit Public Content that you do not want other Users to see.
6.5 Feedback
If you provide suggestions, ideas, requests, comments or feedback about BiteWise, you grant BiteWise the right to use them without restriction or compensation, provided that BiteWise does not use personal data except as described in the Privacy Policy.
6.6 Removal of content
BiteWise may remove, hide, restrict or moderate User Content if it believes the content violates these Terms, applicable law, third-party rights, food-safety principles, platform integrity, community standards or the legitimate interests of BiteWise or its Users.
7. Recipes, Dishes, Ingredients and the Food Database
7.1 Chef-created food content
Chef Users may create and manage dishes, recipes, ingredients, menu categories, dish photos, restaurant information and related Food Data. BiteWise may support nested recipes, dish-as-ingredient logic, recipe components and other structured food-management features.
7.2 Shared Food Database
The Service may include a shared Food Database containing ingredients, additives, allergens and related information. Some Food Data may be created by BiteWise, some may be submitted by Chef Users, and some may be reviewed or moderated by administrators.
7.3 Ingredient changes and moderation
Where the Service allows Chef Users to create or suggest changes to ingredients or Food Data, such changes may be subject to review, quarantine, approval, rejection, deletion or other moderation. Approved changes to shared Food Data may affect dishes, recipes or ingredients used by multiple Users.
7.4 Accuracy and verification
BiteWise may help structure and display Food Data, but it does not guarantee that recipes, ingredients, allergens, additives, calories, nutrition, label recognition, OCR results, AI-assisted outputs or other Food Data are complete, accurate, current or suitable for any particular purpose. Chef Users and restaurants must independently verify Food Data before relying on it.
7.5 No transfer of restaurant secrets
BiteWise does not claim ownership of proprietary restaurant recipes or confidential know-how that you submit. However, you are responsible for deciding what information to store in the Service and for configuring access appropriately. Do not submit trade secrets or sensitive business information unless you are comfortable with the Service processing and storing them in accordance with these Terms and the Privacy Policy.
7.6 Data integrity
BiteWise may modify data structures, normalize formats, deduplicate entries, quarantine changes, remove unsafe entries or adapt Food Data as reasonably necessary to maintain system integrity, improve the Service, prevent abuse, support moderation or comply with law.
8. Intellectual Property
8.1 BiteWise ownership
BiteWise and its licensors own all rights, title and interest in and to the Service, including software, source code, object code, designs, interfaces, databases, workflows, trademarks, logos, service marks, documentation, algorithms, system architecture and other proprietary materials, excluding User Content.
8.2 Limited license to use the Service
Subject to these Terms, BiteWise grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Service for its intended purpose during the time you are authorized to use it.
8.3 Restrictions
- You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble or create derivative works from the Service except where permitted by mandatory law.
- You may not remove, obscure or alter copyright, trademark or proprietary notices.
- You may not use BiteWise branding without prior written permission.
- You may not use the Service to build a competing product by copying its protected design, workflow, database structure, interface or proprietary features.
8.4 Third-party rights
You must not upload or use photos, logos, recipes, text, menu items, trademarks, copyrighted works or other materials unless you own them or have permission to use them. BiteWise may remove allegedly infringing content and may terminate repeat infringers where required or appropriate.
9. Chef Pro Subscription
9.1 Chef Pro
BiteWise may offer Chef Pro as a paid subscription for Chef Users. Chef Pro is intended to provide access to professional restaurant, dish, recipe, ingredient, menu and related management features. The planned standard price is EUR 39 per month unless a different price, billing period, discount, promotion, tax treatment or plan is shown in the Service at the time of purchase.
9.2 Client App
The Client App may be offered free of charge unless BiteWise states otherwise. BiteWise may introduce paid features, premium features or other plans in the future, subject to applicable notice and terms.
9.3 Subscription features
Chef Pro features, limits and availability may depend on the plan selected, payment status, app-store requirements, billing provider availability, technical limitations and applicable laws. BiteWise may add, remove or change subscription features in accordance with these Terms.
9.4 Trial, promotions and changes
BiteWise may offer trials, discounts, promotional pricing or early access plans. BiteWise may change subscription pricing or features, but any material change will apply in accordance with applicable law, platform requirements and the terms shown at the time of purchase or renewal.
10. Payments, Billing and Refunds
10.1 Billing provider
Payments may be processed by BiteWise, an app store, a payment service provider or another billing provider. The provider used may depend on the platform, country, payment method and product purchased.
10.2 Taxes
Prices may be exclusive or inclusive of taxes depending on the jurisdiction and checkout flow. You are responsible for applicable taxes unless the checkout process states that taxes are collected by BiteWise or the billing provider.
10.3 Automatic renewal
If a subscription is sold on a recurring basis, it may automatically renew unless cancelled before the renewal date through the applicable platform, app store, billing provider or account settings. The exact renewal rules will be shown at checkout or in the applicable Subscription and Refund Policy.
10.4 Cancellation
You may cancel a subscription through the available cancellation method. Cancellation generally stops future renewals but does not automatically entitle you to a refund for the current billing period unless required by law, platform rules or the applicable refund policy.
10.5 Refunds
Refunds may depend on applicable law, app-store policies, payment provider rules, consumer rights and the subscription terms shown at checkout. BiteWise may publish a separate Subscription and Refund Policy with more detailed rules.
10.6 Failed payments
If a payment fails, BiteWise may restrict paid features, suspend access to Chef Pro, retry payment, request updated billing information or take other reasonable action. BiteWise will not intentionally delete core restaurant data solely because of a temporary payment failure, but access to paid features may be limited.
11. Account Suspension, Moderation and Reports
11.1 Account status
Accounts or related profiles may have statuses such as active, suspended, pending deletion or deleted. BiteWise may use these statuses to protect the Service, enforce these Terms, process deletion requests, prevent fraud or comply with law.
11.2 Suspension
BiteWise may suspend, restrict or disable access if it reasonably believes that a User has violated these Terms, created legal risk, submitted unsafe or misleading Food Data, abused the Service, infringed rights, attempted fraud, compromised security, manipulated ratings or harmed other Users.
11.3 Moderation of content
BiteWise may hide, remove, restrict, review or mark content as pending review, hidden or removed. Moderation may apply to restaurant profiles, photos, dishes, dish photos, Food Data, comments, ratings, reviews, reports and other content.
11.4 Reports
Users may be able to report public content, restaurants, dishes, comments, reviews, photos or other materials. BiteWise may review reports and may dismiss them, request more information, take action, restrict content or suspend accounts. BiteWise is not required to take a specific action in response to every report.
11.5 Appeals
Where reasonably available, a suspended User may contact BiteWise support to explain the situation or submit an appeal. BiteWise may accept, reject or modify a moderation decision at its discretion, subject to applicable law.
11.6 Serious violations
For serious violations, including fraud, security attacks, illegal content, repeated abuse, attempts to manipulate the Service, or risks to food safety or users, BiteWise may take immediate action without prior warning.
12. Account Deletion and Data Retention
12.1 Client account deletion
Client Users may request deletion of their account through the account settings, where available. The deletion process may require confirmation, such as entering the word DELETE. After confirmation, BiteWise may delete the Client profile, avatar, favorites and other account-linked data, and may delete or anonymize comments, ratings or reviews where appropriate.
12.2 Chef account deletion
Chef Users may request deletion of their account through the Chef App, where available. Because Chef accounts may contain restaurant profiles, dishes, recipes, menu structures, food-management data and professional content, deletion may require email-code verification and may enter a pending deletion state for 30 days.
12.3 Pending deletion and restoration
During the 30-day pending deletion period for Chef Users, the account may be restricted and scheduled for deletion. The Chef User may be able to cancel the deletion request and restore the account before the final deletion date. After final deletion, restoration may not be possible.
12.4 Final deletion
After final deletion, BiteWise may delete or anonymize the account, profile, restaurant data, photos, dishes, recipes, menu categories, user-created files, local saved account data and authentication credentials, subject to technical feasibility, database integrity and lawful retention requirements.
12.5 Data that may be retained
BiteWise may retain certain information where necessary for legal, tax, accounting, billing, fraud prevention, security, dispute resolution, enforcement, audit, compliance or legitimate business purposes. For example, subscription history, invoices, payment events, security logs and records of moderation actions may be retained where legally or operationally required.
12.6 Backups
Deleted data may remain for a limited period in encrypted or protected backups, logs or disaster-recovery systems until overwritten or deleted according to backup retention cycles, unless earlier deletion is technically feasible and required by law.
12.7 Public and shared data
Some data may be part of shared structures, public content, approved Food Database entries or records used by multiple Users. Where deletion would affect data integrity or other Users, BiteWise may anonymize, detach, archive or transform the data rather than remove every technical record.
13. Availability, Support and Changes to the Service
13.1 Availability
BiteWise aims to provide a reliable Service but does not guarantee uninterrupted, error-free or continuous availability. The Service may be unavailable due to maintenance, updates, technical issues, third-party service failures, internet disruptions, security events, force majeure or circumstances outside BiteWise control.
13.2 Support
Support may be provided through the support channels made available by BiteWise, such as contact forms, in-app support, email or help pages. BiteWise may prioritize support requests based on severity, subscription status, security impact and operational capacity.
13.3 Changes
BiteWise may modify, improve, suspend, discontinue or replace features, interfaces, plans, databases, workflows or parts of the Service. BiteWise will take reasonable steps to avoid unnecessary disruption and, where required, provide notice of material changes.
13.4 Beta and experimental features
BiteWise may offer beta, preview, OCR, AI-assisted or experimental features. Such features may be incomplete, inaccurate, unstable or discontinued at any time. You should not rely on beta or experimental outputs without independent verification.
14. Food, Nutrition, Allergens and Safety Disclaimer
14.1 No medical or dietary advice
BiteWise does not provide medical, nutritional, dietary, allergy, food-safety or professional health advice. Any food, nutrition, allergen, additive, calorie, ingredient, label, OCR or AI-assisted information shown in the Service is for informational and organizational purposes only.
14.2 Allergens and additives
Allergen and additive information may be incomplete, inaccurate, outdated or affected by user input, recipe changes, ingredient substitutions, supplier changes, labeling errors, OCR limitations, AI limitations or database errors. Users with allergies, intolerances or dietary restrictions must independently verify ingredients and consult the restaurant or qualified professional before consuming any food.
14.3 Chef and restaurant responsibility
Chef Users and restaurants are responsible for verifying recipes, ingredients, allergens, additives, nutrition and menu information before using the Service in a professional context or presenting information to customers. BiteWise is a tool and does not replace professional judgment, food-safety procedures, legal labeling obligations or staff training.
14.4 OCR and AI-assisted outputs
If BiteWise provides OCR, label recognition, AI-assisted extraction or automated classification, those outputs may be wrong. They must be reviewed by a human before being relied on. BiteWise does not guarantee the accuracy of automated recognition or generated outputs.
14.5 Emergency situations
The Service should not be used as the sole source of information in emergency, medical, allergy or food-safety-critical situations. If you have a serious allergy or medical condition, consult qualified professionals and verify information directly with the food provider.
15. Privacy and Data Protection
15.1 Privacy Policy
BiteWise processes personal data as described in its Privacy Policy. The Privacy Policy explains what data is collected, how it is used, how long it may be retained, with whom it may be shared and what rights may apply.
15.2 User-controlled data
Where Chef Users or restaurants upload personal data of staff, customers or other individuals, they are responsible for having a lawful basis and required notices or consents for such processing. BiteWise may act as a processor or service provider for certain business customer data where applicable and may require a separate data processing agreement.
15.3 Security
BiteWise uses reasonable technical and organizational measures designed to protect the Service. However, no system is completely secure, and BiteWise cannot guarantee absolute security.
15.4 International use
The Service may be accessed internationally. Data may be processed in countries where BiteWise, its infrastructure providers or service providers operate, subject to applicable data protection laws and safeguards described in the Privacy Policy.
16. Third-Party Services and App Stores
16.1 Third-party services
The Service may integrate with or depend on third-party services, such as hosting providers, authentication providers, storage providers, analytics tools, app stores, payment processors, maps, OCR services, AI providers or other infrastructure services. BiteWise is not responsible for third-party services outside its control.
16.2 App stores
If you download the Service from Apple App Store, Google Play or another app store, your use may also be subject to that app store's terms, rules and payment policies. In case of conflict between these Terms and mandatory app-store rules, the app-store rules may control for app-store distribution, payments or refunds.
16.3 Third-party content
The Service may display links, data, content or materials from third parties. BiteWise does not endorse or control third-party content and is not responsible for its accuracy, legality or availability unless required by law.
17. Warranty Disclaimer
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. BiteWise disclaims all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, security and error-free operation. BiteWise does not warrant that the Service will meet your requirements, that Food Data will be accurate, that allergens or additives will be complete, that content will be preserved without loss, that the Service will be uninterrupted, or that defects will be corrected. Some jurisdictions do not allow certain disclaimers. In such cases, the disclaimers apply only to the maximum extent permitted by law.
18. Limitation of Liability
To the maximum extent permitted by law, BiteWise and its directors, officers, employees, contractors, affiliates, licensors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, business, goodwill, data, content, recipes, restaurant information, opportunity or anticipated savings, even if advised of the possibility of such damages. To the maximum extent permitted by law, BiteWise's total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount paid by you to BiteWise for the Service during the three months before the event giving rise to the claim; or (b) EUR 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct, gross negligence, death or personal injury where such limitation is prohibited, or mandatory consumer rights.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless BiteWise and its directors, officers, employees, contractors, affiliates, licensors and service providers from and against claims, damages, liabilities, losses, costs and expenses, including reasonable legal fees, arising out of or related to:
- your use or misuse of the Service;
- your User Content or Food Data;
- your violation of these Terms or applicable policies;
- your violation of law, food-safety obligations, consumer protection rules or third-party rights;
- your restaurant, business, employees, contractors, customers or representatives;
- any allegation that content, photos, recipes, logos, menus or other materials you submit infringe or violate third-party rights.
BiteWise will use reasonable efforts to notify you of any claim subject to indemnification and may control the defense or settlement where appropriate. You may not settle a claim in a way that imposes obligations on BiteWise without BiteWise's written consent.
20. Term and Termination
20.1 Term
These Terms apply from the moment you access or use the Service and continue until your account is deleted, your subscription ends, or your access is otherwise terminated, subject to provisions that survive termination.
20.2 Termination by you
You may stop using the Service at any time. You may request account deletion where available. Cancelling a subscription and deleting an account are separate actions unless the Service or billing provider clearly states otherwise.
20.3 Termination by BiteWise
BiteWise may suspend or terminate access if you violate these Terms, fail to pay applicable fees, create legal or security risk, misuse the Service, infringe rights, submit unsafe content, or if BiteWise discontinues the Service or is required to do so by law or a platform provider.
20.4 Effect of termination
Upon termination, your right to access the Service ends. BiteWise may delete, retain or anonymize data in accordance with these Terms, the Privacy Policy, Account Deletion Policy and applicable law. Provisions relating to intellectual property, content licenses, disclaimers, liability, indemnity, data retention, payment obligations and general provisions survive termination where appropriate.
21. Changes to These Terms
BiteWise may update these Terms from time to time to reflect changes in the Service, law, app-store rules, payment providers, business practices or operational requirements. The updated version will show a new "Last Updated" date. For material changes, BiteWise may provide notice through the Service, email or other reasonable means. Continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the Service and, where applicable, cancel your subscription.
22. Governing Law and Dispute Resolution
The governing law and jurisdiction should be completed by qualified legal counsel based on the legal entity operating BiteWise, the target market, consumer law requirements, mandatory EU rules and German law considerations. Draft placeholder: These Terms are governed by the laws of [Jurisdiction], excluding conflict-of-law rules, unless mandatory consumer protection laws provide otherwise. Courts located in [Venue] will have jurisdiction, unless applicable law provides a mandatory alternative forum for consumers. For consumers in the European Union, mandatory consumer rights and mandatory local jurisdiction rules may apply regardless of the governing law clause.
23. General Provisions
23.1 Entire agreement
These Terms, together with the policies and documents referenced in them, constitute the entire agreement between you and BiteWise regarding the Service and replace any prior or contemporaneous understandings on the same subject.
23.2 Severability
If any provision of these Terms is held invalid, illegal or unenforceable, the remaining provisions remain in effect. The invalid provision will be interpreted or replaced to achieve its original purpose as closely as permitted by law.
23.3 No waiver
BiteWise's failure to enforce any provision is not a waiver of its right to do so later.
23.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without BiteWise's prior written consent. BiteWise may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control or operation of the Service.
23.5 Force majeure
BiteWise is not responsible for delay or failure to perform caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, internet failures, hosting failures, cyberattacks, government actions, pandemics, natural disasters or utility outages.
23.6 Language
This English Master Version is prepared for legal review and translation. If BiteWise publishes multiple language versions, the controlling language should be specified by legal counsel. Consumer law may require that users receive terms in a language they can reasonably understand.
24. Contact Information
Questions about these Terms may be sent to: BiteWise Legal Contact: [To be completed] Email: [To be completed] Registered Address: [To be completed] Company Registration Number: [To be completed] VAT ID: [To be completed, if applicable]
